General information
EmiTel S.A. (“Emitel”) operates and administers an internet services www.emitel.pl, forum.emitel.pl, mux8.tv, mux8.pl, emimaps.emitel.pl (“Services”) made available to the users of the Services (“Service Users”). To fully protect the rights of the Service Users, please read the information below before using the Services.
Liability
The Services provides only general information. Emitel does not provide any guarantees concerning the form and content of information in the Services, including, but not limited to, relevance, accuracy, completeness, detail and usefulness of the information for specific Service Users’ purposes. Emitel shall not be liable for any damages for Service Users or third parties arising from the use of the Services. The Service User shall bear any and risks related to the use of the Service, including the risk associated with the use of information included in the Services.
Emitel may amend any information in the Services at any time chosen by Emitel, with no obligation to notify the Service Users of the same in advance.
Copyright
Any rights to the Services, including the rights to its graphical elements or layout of particular pages or any other elements of the Services are reserved. The Services and all elements thereof are protected under the law, including the Copyright and Related Rights Act of 4 February 1994 (consolidated text: Journal of Laws of 2000 No. 80 item 904, as amended), the Act of 16 April 1993 on combating unfair competition (Journal of Laws of 1993 No. 47 item 211, as amended) and the Databases Protection Act of 27 July 2001 (Journal of Laws of 2001 No. 128 item 1402, as amended).
The Services may be used only under so called “permitted use” of the Service User, i.e. only for private and non-commercial purposes, on condition that no rights under the law, including copyright and trademark rights, are infringed. The use of the Service for other purposes is subject to a respective written agreement with Emitel.
Privacy
To protect and respect the privacy of the Service Users, any personal data published in the Services or processed for the Service purposes, including the data of the Service Users, are legally protected under the Personal Data Protection Act of 29 August 1997 (consolidated text: Journal of Laws of 2002 No. 101 item 926, as amended).
Processed data
For the purpose of operating the Service, Emitel shall collect and process the following personal data of the Service Users:
• e-mail addresses sent by Service Users to Emitel;
• information about the use of the services by users and their IP addresses on the basis of the analysis of access logins; the said data shall be processed by Emitel for technical and statistical purposes in case of the demographic analysis of the Service Users.
Emitel shall treat any and all above-mentioned personal data as provided voluntarily, under Article 23.1.1 of the Personal Data Protection Act. Emitel shall not be liable in case any of the Service Users provides untrue or incomplete data.
Emitel may process personal data included in the recruitment form, and provided e-mail addresses, under a respective separate consent, for the purpose of the marketing of goods and services and third party goods and services in which Emitel has majority stakes, pursuant to 4 § 1.4 of the Act of 15 September 2000 – Code of Commercial Companies.
Data availability and use
Emitel shall not sell, disseminate or discloses the processed data, unless:
• it is required under the law;
• it is necessary to take measures for public good, as provided by the law;
• it is necessary to accomplish the legally justified objectives of EmiTel, and the processing does not infringe any rights and freedoms of the person whose data are sold, disseminated or disclosed.
Emitel reserves the right to disclose the Service Users’ data in the form of summary reports to cooperating agencies or services. Such data may be used to:
• monitor the traffic in the Services;
• monitor the number of visits on the Services
• and other statistics and analytics purposes of Emitel
